1. Acceptance of Terms

These Hibbly terms of service govern your use of the Hibbly website, the registration flow and any related features (collectively, the "Service"). Accessing the site, starting the signup process, completing the matching quiz or creating an account each constitute acceptance of this agreement in full.

If you do not agree with any part of these terms, you must stop using the Service immediately and refrain from creating an account. Continued use after any point of access confirms your ongoing acceptance of the terms then in effect, including any updates described in Section 13.

2. Eligibility: Strictly 18+ Adults Only

3. Account Registration and Member Responsibilities

You agree to provide truthful, current information about yourself, including your gender, the gender(s) you are interested in matching with, and your age. Profiles built on false identities, borrowed photos or fabricated details are prohibited and may be removed at any time.

3.2 Credential Security

You are responsible for safeguarding any login credentials associated with your account and for restricting access to your device. Notify Hibbly promptly if you suspect unauthorized access.

3.3 One Account Per Person

Each member may maintain only one active account. Additional member duties include:

• Keeping your contact and preference details reasonably up to date
• Not allowing another person to use your account or profile
• Accepting full responsibility for all activity that occurs under your login
• Complying with all applicable local, state and federal laws while using the Service

4. Acceptable Use and Prohibited Conduct

Hibbly's online dating terms and conditions exist to keep the platform usable for people seeking genuine connections. The following conduct is prohibited on the Service:

• Creating fake, duplicate or impersonated profiles, including catfishing or misrepresenting your identity, age or intentions
• Using bots, scripts or other automated tools to create accounts, message members or manipulate matching
• Harassment, hate speech, threats, stalking or any conduct intended to demean or intimidate another member
• Soliciting money, gifts, cryptocurrency or financial information from other members, including romance-scam behavior
• Sending spam, chain messages, or promoting outside businesses, escort services, or unrelated commercial offers
• Collecting, sharing or publishing another member's private information without consent
• Scraping profile data, reverse engineering the Service, or attempting to bypass security or verification features
• Posting sexually explicit imagery, content involving minors, or content that violates applicable law

Violations of this section may result in content removal, temporary suspension, permanent termination, and referral to law enforcement where required by law. Hibbly reserves the right to investigate suspected violations and to take action at its discretion.

5. Subscriptions, Billing and Cancellation

Hibbly may offer optional paid features or subscription tiers in addition to free registration and browsing. Where paid features exist, applicable charges, billing cycle and any trial conditions are disclosed to you before you complete a purchase, and no payment is collected without your affirmative action to buy.

Paid subscriptions, where offered, may renew automatically at the end of a billing period unless cancelled before the renewal date. Cancellation is available through account settings or by contacting support, and takes effect according to the method and timing disclosed at the time of purchase. Refunds, where applicable, are handled in accordance with the specific offer terms shown at checkout and applicable consumer protection law.

Hibbly does not guarantee a specific number of matches, messages or dating outcomes in exchange for any payment. Pricing, currency and available features may vary by market and are subject to change with notice as described in Section 13.

6. Content and Intellectual Property

6.1 Hibbly Materials

The Hibbly name, logo, interface design, software, graphics and underlying technology are owned by Hibbly or its licensors and are protected by intellectual property law. Nothing in these terms grants you rights to reproduce, modify or distribute Hibbly's branding or platform code outside normal use of the Service.

6.2 Member Content License

By submitting photos, profile text, messages or other content, you grant Hibbly a limited, non-exclusive, royalty-free license to host, store and display that content as necessary to operate and provide the Service to you and to the members you interact with. You retain ownership of content you submit and may request its removal by deleting your account.

6.3 Feedback

If you submit suggestions or feedback about the Service, Hibbly may use that feedback to improve the platform without obligation or compensation to you.

7. User-Generated Content and Conduct Between Members

Members are solely responsible for the content they post and for their conduct in interactions with other members, including messages, profile descriptions and any arrangements made outside the platform. Hibbly does not create, verify or endorse member-to-member communications.

Hibbly may, but is not obligated to, monitor, review or remove content that appears to violate these terms. If you encounter behavior that concerns you, use the in-app report or block controls to flag a profile or message for review, or contact [email protected]. Blocking a member immediately stops further contact from that profile within the Service.

8. Safety Disclaimers and Meeting In Person

Hibbly does not conduct criminal background checks on members and cannot guarantee the identity, intentions or safety of any person you meet through the Service. You are solely responsible for exercising caution and judgment in every interaction, online and offline.

The following practices reduce common risks associated with online dating:

• Meet for the first time in a public place with other people around
• Tell a friend or family member where you're going and who you're meeting
• Arrange your own transportation to and from the meeting
• Never send money, gift cards or financial account details to another member
• Keep early conversations on-platform rather than moving to personal contact channels immediately

If you suspect another member of fraudulent or predatory behavior, report it to Hibbly and, where appropriate, to local law enforcement.

9. United States Consumer Protection Background

The Federal Trade Commission is the primary US federal agency charged with protecting consumers from unfair and deceptive business practices affecting commerce, a mandate that Congress broadened in 1938 and that the agency continues to carry out today. This background is provided for general context and is not a statement that Hibbly holds any specific certification, endorsement or compliance status from the FTC or any other agency.

If you encounter a scam, fraudulent solicitation or other suspected illegal practice while using an online platform, you can report it directly to the FTC at ReportFraud.ftc.gov. 10. Disclaimer of Warranties and Limitation of Liability

Hibbly does not warrant that the Service will be uninterrupted or error-free, that any particular match will occur, or that any member's conduct, statements or identity will meet your expectations or standards.

10.2 Limitation of Liability

To the fullest extent permitted by applicable law, Hibbly and its officers, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service, including damages related to interactions with other members, loss of data, or loss of anticipated benefits, even if Hibbly has been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

11. Suspension and Termination of Accounts

Hibbly may suspend or terminate your account, with or without notice, for violations of these terms, suspected fraudulent activity, extended inactivity, or at Hibbly's discretion to protect the community. You may also delete your own account at any time through account settings.

Upon termination, your right to access the Service ends immediately, and any paid features tied to the account are discontinued subject to the billing terms in Section 5. Handling of your personal data after termination is described in the Privacy Policy, including applicable retention and deletion timelines.

12. Dispute Resolution and Governing Law

These terms are governed by the laws of the United States and the state in which Hibbly is registered, without regard to conflict-of-law principles. Before initiating formal proceedings, you agree to first attempt to resolve any dispute informally by contacting [email protected] and allowing a reasonable period for resolution.

If informal resolution fails, disputes will be resolved in the state or federal courts located in Hibbly's state of registration, and you consent to the personal jurisdiction of those courts. You agree that any proceeding will be conducted on an individual basis, and you waive any right to participate in a class, consolidated or representative action to the extent permitted by law.

If any provision of these terms is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

13. Changes to These Terms

Hibbly may revise these terms from time to time to reflect changes in the Service, legal requirements or business practices. Material changes will be reflected by an updated "Last updated" date at the top of this page, and where required by law, additional notice may be provided. Continued use of the Service after an updated effective date constitutes acceptance of the revised terms.
